Membership Hold Request

You have requested a temporary, discretionary hold on your membership . 

  • You must read and acknowledge this addendum for your hold to take effect If you do not respond prior to your next expected billing, the hold will be of no effect and you will be billed as if no hold were ever requested.

TEMPORARY HOLD POLICY AND ADDENDUM TERMS

CFR retains the right, at its sole discretion, to place memberships on a temporary hold for any reason, unless you — the member — expressly decline.

A temporary hold suspends (1) use of the membership and (2) billing for the membership for the duration of the hold: the member may not use CFR facilities for the duration of the hold and the member will not be billed for any period of time encompassed within the hold period. 

HOLD POLICY TERMS

Member Request: At the sole discretion of CFR, a hold may be placed on a membership at the request of a member according to the following terms:

  • only once during the term of the active contract (additional holds may be available at the discretion of CFR and subject to additional terms);
  • for up to six (6) months (additional hold length may be available at the discretion of CFR and subject to additional terms);
  • subject to a nonrefundable Membership Hold Request Fee of $15 per 30-day period or fraction thereof (CFR will waive this fee if the request is due to injury or illness);
  • unless hold is requested more than 15 days prior to the next scheduled billing, hold goes into effect after the next billing posts (except for injury/illness, which becomes effective immediately);
  • member may terminate the hold early, upon request;
  • RETROACTIVE BILLING IN THE EVENT OF RELOCATION OR LATER DISABILITY 
    • A discretionary hold is designed to benefit the member due to an agreed-upon circumstance that both the member and CFR expect to be temporary. It is not intended to have a negative effect on the total value of the member’s contract with CFR.
    • In the event that the member relocates to a residence more than 25 miles away from CFR, or becomes disabled for purposes of the California Health Studio Contracts law — at any time during a specific membership term — CFR and the member agree that all amounts that would have otherwise accrued during the hold period shall be considered earned by CFR. Accordingly,
      • In this instance, CFR retains the right to bill the member for the value of the time period encompassed by the discretionary hold period up to the date of relocation or disability, as permitted by law; and
      • member agrees to pay such accrued value (which will not cause the total value of the contract to increase).

Effect on Membership Contract Term: A membership hold will extend the length of the membership contract by the length of the hold (though it will not cost the member any additional money, except the Membership Hold Request Fee).

Example (timely request): assume the membership term bills on the 10th of each month and expires on January 10, 2001. If the member requests a 3-month discretionary hold on October 20, 2000, the hold goes into effect immediately and billing stops immediately. The hold would expire on January 20, 2001, regular billing would resume on February 9, 2001, and the membership expires on April 10, 2001.

Example (late request): assume the membership term bills on the 10th of each month and expires on January 10, 2001. If the member requests a 3-month discretionary hold on November 5, regular billing would occur on November 10, and usage and billing would stop on November 11, 2000; membership resumes automatically on February 6, and the membership expires on April 10.
